1. What Daybreak is
Daybreak is a daily newspaper for children aged nine to eleven. Each story is written from reported news and reviewed by a person before it is published.
It is a newspaper, not a school resource, and it is not a substitute for a teacher or for a grown-up's judgement about what their child is ready to read.
2. Who agrees to this
An adult. You must be eighteen or over to set up a household. By setting one up you confirm you are the parent or guardian of the children you add, or have their parent's or guardian's permission.
Children do not agree to these terms and cannot set up an account.
3. What you may do
Read Daybreak on your household's devices, for your household.
4. What you may not do
- Copy, republish or redistribute Daybreak's articles, pictures or recordings. A story may be read aloud at home or shown to a teacher; it may not be reprinted, posted publicly or used in another product.
- Use Daybreak or anything in it to train a machine learning model.
- Share your household passcode outside your household.
- Try to reach the service other than through the app.
5. What we may do
We may change what Daybreak contains, how often it publishes, and how it works. If a change removes something you pay for, clause 7 applies.
We may suspend or end an account that breaches these terms. We will say why.
6. Subscriptions, when they exist
Subscriptions are sold through Apple's App Store, and Apple's own terms govern payment, renewal and refunds. Prices are shown in the app before purchase.
A subscription renews until it is cancelled. Cancel through the App Store, not through us — we cannot cancel it on your behalf.
You have the right to cancel within 14 days of buying a subscription under the Consumer Contracts Regulations 2013. Because the service begins immediately, this right may be reduced once you start using it. Apple handles refunds.
7. If we stop
If Daybreak closes, or a subscription feature is withdrawn, we will give reasonable notice in the app and refund the unused part of anything paid for in advance.
8. Accuracy
Daybreak is written from reported news and checked before publication, but news is provisional and mistakes happen. We correct them when we find them.
We do not promise that a story is complete, or that a fact will still be true tomorrow. Where something important is not yet known, the paper says so.
9. What we are responsible for
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.
We are not liable for loss that was not foreseeable, or for business losses.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Your statutory rights as a consumer are not affected.
10. Privacy
How we handle information is set out in the Privacy Policy, which forms part of these terms.
11. Changes to these terms
We will tell you in the app before a change takes effect. If you do not accept it, you may delete your account; if you had paid in advance, clause 7 applies.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
